Give a power of attorney from abroad

A power of attorney lets someone in India act for you, for example to sell property or deal with a bank.

Keep these ready

Steps

  1. Write down exactly what the person may do. Get the draft checked by a lawyer in India if it involves property.
  2. Sign it in front of a local notary and get an apostille if your country is in the Hague Apostille Convention (USA, UK, Canada, Australia, most of Europe). Otherwise, sign it at the Indian embassy or consulate.
  3. Send the original to the person in India by courier and keep the tracking record.
  4. In India, pay the stamp duty within 3 months of the document arriving. The rate depends on the state.
  5. If it is for selling or buying property, register it at the sub-registrar office where the property is.
